1. Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of the website and online services operated for Weaver Construction Southeast ("Weaver," "we," "us," or "our"). By accessing or using the website, submitting a form, requesting a quote, or using an online feature, you agree to these Terms and our Privacy Policy.
If you do not agree, do not use the website.
2. Website Information Is General
Website content is provided for general informational and marketing purposes. Roofing conditions vary by property, roof system, age, installation history, weather exposure, structural conditions, local code, permitting requirements, product approvals, access, and hidden conditions.
Nothing on the website is a substitute for an on-site inspection, engineering advice, legal advice, insurance coverage determination, code determination, or a signed construction agreement applicable to a particular property.
3. Online Quotes, Estimates & Inspections
Any online, automated, "60-second," preliminary, budgetary, or remote quote is an estimate only unless Weaver expressly states otherwise in a signed written agreement. Online estimates may rely on third-party property data, measurements, user-provided information, assumptions, imagery, or typical pricing inputs that can be incomplete or inaccurate.
Final scope and price may change after inspection, measurement, product selection, permit review, discovery of hidden conditions, decking or structural issues, access limitations, code requirements, material availability, or other project-specific factors. An inspection request or quote request does not obligate you to purchase services and does not obligate Weaver to accept a project.
4. Roofing & Construction Contracts
Actual roofing or construction work is governed by the written proposal, contract, scope of work, addenda, change orders, warranty terms, and other documents signed or accepted for that specific project. Those documents may include important terms concerning payment, deposits, cancellation, permits, hidden conditions, decking, scheduling, weather, access, cleanup, warranties, dispute procedures, and other obligations.
Website statements about products, warranties, financing, timing, service areas, or availability are general and may change. Always rely on the final written documents for your project.
5. Information & Content You Submit
You agree that information you submit through the website is accurate to the best of your knowledge and that you have the right to provide it. Do not submit unlawful content, confidential information belonging to someone else without authorization, malware, or material that infringes another person's rights.
If you submit photos, reviews, testimonials, project information, or other content for publication or marketing, any separate release, review-platform terms, or written permission controls the extent to which Weaver may use that content.
6. Calls, Email & Text Communications
By providing contact information and requesting service, you authorize Weaver to contact you about your inquiry, appointment, estimate, project, or customer-service matter using the contact methods you provide, subject to applicable law.
Marketing communications require any consent required by law. If you opt in to text messages, message frequency may vary and message or data rates may apply. Consent to marketing texts is not a condition of purchasing services. You may revoke consent through a reasonable method, including replying STOP when reply functionality is available or contacting Weaver directly.
You are responsible for ensuring that the phone number or email address you provide belongs to you or that you are authorized to use it.
7. Financing, Payments & Third-Party Services
Financing offers, payment services, map tools, review platforms, manufacturer resources, social platforms, and other third-party services may be provided by independent companies. Their eligibility rules, rates, fees, privacy practices, terms, approvals, and decisions are controlled by those companies.
Weaver does not guarantee financing approval, interest rates, promotional terms, insurance coverage, manufacturer warranty approval, or third-party service availability unless expressly stated in a separate written agreement signed by the responsible party.
8. Intellectual Property
Unless otherwise stated, the website's original text, design, layout, graphics, logos, branding, photographs, videos, code, and other content are owned by or licensed to Weaver and are protected by applicable intellectual-property laws.
You may view and print reasonable portions of the website for personal, noncommercial use. You may not reproduce, scrape, republish, sell, modify, distribute, create derivative commercial content from, or misuse protected website materials without permission or a lawful exception.
9. Prohibited Uses
You may not use the website to:
- Violate law or another person's rights.
- Transmit malicious code, interfere with security, probe vulnerabilities, or disrupt website operation.
- Use automated systems to scrape or harvest data in a manner that burdens the site or violates applicable law.
- Impersonate another person or submit false, deceptive, fraudulent, or misleading information.
- Attempt unauthorized access to accounts, systems, forms, databases, or nonpublic website functions.
10. Website Disclaimers
To the maximum extent permitted by law, the website and its general content are provided on an "as available" basis. Weaver does not warrant that the website will always be uninterrupted, error-free, secure, current, complete, or suitable for every property or purpose.
Product photographs, colors, examples, measurements, project images, service descriptions, expected lifespans, savings, performance statements, schedules, and other website content may be illustrative or depend on conditions outside Weaver's control. Manufacturer specifications and the final written project documents control where applicable.
Nothing in these Terms excludes a warranty, duty, remedy, or right that cannot lawfully be excluded.
11. Limitation of Liability
To the maximum extent permitted by law, Weaver and its owners, officers, employees, agents, affiliates, and website service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising solely from use of or inability to use the website or reliance on general website content.
This website limitation does not replace or reduce obligations expressly assumed by Weaver in a signed project agreement, and it does not limit liability that cannot legally be limited.
12. Indemnification
To the extent permitted by law, you agree to be responsible for claims, losses, or expenses arising from your unlawful misuse of the website, your material violation of these Terms, or content you submit in violation of another person's rights. This section does not apply to claims caused by Weaver's own conduct to the extent responsibility cannot lawfully be shifted.
13. Governing Law
These website Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles, except where federal law or another mandatory law applies. Any dispute-resolution, venue, arbitration, or governing-law provision contained in a signed project agreement controls for disputes arising from that project.
14. Changes to These Terms
We may revise these Terms as the website, services, or legal requirements change. The version posted on the website with the most recent "Last Updated" date governs website use after publication, except that changes will not retroactively alter a signed project agreement.
If any provision of these Terms is held unenforceable, the remaining provisions remain in effect to the extent permitted by law. Failure to enforce a provision does not waive the right to enforce it later.
